Disney signed a Licensing Agreement with OpenAI for using its characters. Whilst ByteDance danced on the Cease and Desist notice, and now have pledged to safeguard the IP Rights. At Least ByteDance took a pledge to respect the BERNE; UNLIKE other AI companies & search engines, who were training their modules vide scrapping WEB, and busy putting blame on the USERS only, for generating an infringed output. That’s why in one of my earlier blogs I’ve mentioned that, use these generative AI platforms etc. mostly either for personal use or for the R&D activities, despite of their non-deterministic nature.
Disney’s problem is resolved with the licensing agreements; by sending cease and desist notice etc. But what about the DATA of others, scrapped from the WEB for LLMs? The Search Engines profiling USERS’s data and habits for Clickbait ADS’s revenues? What about those void-ab-initio Browsewrap, Clickwrap Agreements? Neither USERS would ever come to know whose DATA was fed, nor have the capacity for sending such cease and desist notices, the trial of which that would take a decade to complete; by the time AGI would be already governing us. CUTE!
Of course, themes and ideas are not copyrightable, BUT, please note that once they are reduced into expressions on the paper or screen, like in the case of GHIBLI ART, as that acquired the known theme status for decades in the Market, then indeed, those expressions and ideas are copyrightable.
Please don’t turn Internet into a ponzi scheme. Eat and Slurp on the Cookies; take the DATA, run your Crawlers onto it; and then, either use it for the purpose for ADS, or, for training of the AI modules. And in return, with the endless FEEDS & Comments, serve brain rot on the screen.
Why ByteDance had to backoff, because the entire Motion Picture Association came together, with their Legal Eagles sending Cease and Desist notice. This is what other USERS cannot do, nor any license Agreements can be signed with them. Alas, the damage has already been done in the last 10-14 years.
AI is great. AGI would be Marvelous. But don’t make it evolve like we evolved! 🙂
